These Terms of Service ("Terms") govern your use of the Constancy mobile application and related services (the "App"), provided by Caleb ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are between 13 and the age of legal majority where you live, you may use the App only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the App, you represent that you meet these requirements.

You retain ownership of the content you create in the App (such as workout notes and templates). You grant us a limited license to store and process that content solely to provide the App to you. You are responsible for the content you submit and confirm you have the right to submit it.
The App is not a medical device and does not provide medical advice, diagnosis, or treatment.
Constancy offers general fitness tracking and automatically generated or suggested workout content. This information is for general informational and educational purposes only. It is not tailored to your individual health circumstances and should not be relied upon as a substitute for advice from a qualified physician, physical therapist, or other healthcare professional.
The App may offer paid features, in-app purchases, or subscriptions. If and when offered, all payments are processed through Google Play and are subject to Google Play's terms. Subscriptions may renew automatically unless cancelled through your Google Play account before the renewal date. Except where required by law, payments are non-refundable; refund requests are handled according to Google Play's refund policies.
The App, including its design, features, and content we provide, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to our trademarks, logos, or branding.
The App relies on third-party services (including Supabase, Cloudflare, and Google Play). We are not responsible for the practices of these third parties, and their terms and privacy policies govern your use of their services.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that data will never be lost.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or personal injury, arising from or related to your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Caleb from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App or your violation of these Terms.
We may suspend or terminate your access to the App at any time if you violate these Terms or for any other reasonable cause. You may stop using the App and delete your account at any time.
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Texas, unless applicable law provides otherwise.
